Resumo
Consumer law, intellectual property rights, and competition law are EU law’s sectors which require high levels of efficiency to allow an appropriate functioning of the internal market. From a civil procedure perspective, the EU legal instruments demonstrate that efficiency is connected with an increase of the judiciary’s case management powers. This tendency is confirmed by the European Parliament Resolution of July 2017 with recommendations to the Commission on common minimum standards of civil procedure in the EU. However, these recommendations must fulfill the requirements of the judicial impartiality established by art. 6.1 ECHR.
