Aproximación al matrimonio forzado desde la óptica de las víctimas

Resumen

El matrimonio forzado constituye un fenómeno que se ha abordado fundamentalmente a través de la incriminación desde la firma del Convenio del Consejo de Europa sobre prevención y lucha contra la violencia contra las mujeres y la violencia doméstica (Convenio de Estambul) de 2011. Partiendo de una visión orientalista, la mayor parte de países europeos han sancionado penalmente estas conductas sin efectuar antes el correspondiente estudio empírico que permita conocer esta realidad y sin articular otros mecanismos de protección para las víctimas al margen del recurso al Derecho Penal. Para colmar este vacío de investigación empírica en España, una vez constatada la existencia de experiencias de matrimonio forzado mediante la realización de un estudio cuantitativo con entidades prestadoras de asistencia a víctimas a nivel nacional, decidió emprenderse un estudio cualitativo con víctimas. Partiendo del convencimiento de que el diseño de un programa adecuado para asistir a las mismas pasa por conocer en profundidad el padecimiento que este tipo de procesos produce en quienes los sufren y lo que para las víctimas resulta deseable en términos de asistencia y protección, se llevó a cabo una investigación cualitativa consistente en 5 entrevistas en profundidad a víctimas de matrimonio forzado cuyos principales resultados se exponen aquí.
